Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the website and services provided by Aldrige & Ochre Landscaping Services ("we," "our," or "us"). By accessing or using our website or services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

Services

Aldrige & Ochre Landscaping Services provides various landscaping, garden design, and maintenance services as described on our website. All services are subject to availability and we reserve the right to refuse service to anyone for any reason at any time.

We strive to provide accurate descriptions of our services, but we do not warrant that service descriptions or other content on our website are accurate, complete, reliable, current, or error-free.

Quotations and Contracts

All quotations provided by us are valid for 30 days from the date of issue unless otherwise stated. Quotations are subject to revision if any changes to the original specifications are requested.

A contract between you and us is formed when you accept our quotation in writing or when we start providing the services to you, whichever is earlier. Once a contract is formed, it can only be varied by written agreement between both parties.

Payment Terms

Payment terms will be specified in the quotation or contract. Unless otherwise agreed:

• For projects valued at less than £1,000, full payment is required upon completion of the work.
• For projects valued at £1,000 or more, a deposit of 40% is required before commencement of work, with the balance due upon completion.
• For maintenance contracts, payment is required monthly in advance.

We accept payment by bank transfer, credit/debit card, or cheque. Late payments may be subject to interest charges in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

Cancellation and Refunds

If you wish to cancel a contract, you must notify us in writing. Cancellation terms are as follows:

• Cancellation more than 14 days before scheduled commencement: Full refund of any deposit paid.
• Cancellation between 7-14 days before scheduled commencement: 50% refund of any deposit paid.
• Cancellation less than 7 days before scheduled commencement: No refund of deposit.

For ongoing maintenance contracts, you may cancel at any time with 30 days' written notice.

Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is our property or that of our suppliers and is protected by copyright, trademark, and other intellectual property laws.

Garden designs created by us remain our intellectual property until full payment has been received, after which you are granted a license to use the design for the specific property for which it was created.

Warranties and Limitations

We warrant that our services will be performed with reasonable care and skill in accordance with industry standards. For plants and materials, warranties will be provided in accordance with the manufacturer's or supplier's warranty where applicable.

We provide a 12-month guarantee on our workmanship, subject to proper maintenance and care as advised by us. This guarantee does not cover damage due to weather, pests, or improper care.

To the maximum extent permitted by law, we exclude all other warranties, whether express or implied, and we will not be liable for any indirect, incidental, or consequential damages.

Your Responsibilities

You are responsible for:

• Providing accurate information about your property and requirements
• Obtaining any necessary permissions or permits for the work
• Providing reasonable access to your property for the performance of our services
• Informing us of any utility lines, pipes, or cables that may be affected by our work
• Maintaining plants and landscaping features in accordance with our care instructions

Force Majeure

We will not be liable for any delay or failure to perform our obligations under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, adverse weather conditions, labor disputes, or governmental restrictions.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our website or services after any changes indicates your acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
